1.0 Acceptance of terms
Your access to and use of nu.today and associated aliases (“the Website”), is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.
The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
3.0 Changes to website
Nü Bamboo reserves the right to:
3.1 change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Nü Bamboo shall not be liable to you for any such change or removal; and
3.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
4.0 Links to third party websites
The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
5.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Nü Bamboo or otherwise used by Nü Bamboo as permitted by law.
5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.
6.0 Disclaimers and limitation of liability
6.1 The Website is provided on an “AS IS” and “AS AVAILABLE” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
6.2 To the extent permitted by law, Nü Bamboo will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
6.3 Nü Bamboo makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
6.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Nü Bamboo for death or personal injury as a result of the negligence of Nü Bamboo or that of its employees or agents.
You agree to indemnify and hold Nü Bamboo and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Nü Bamboo arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
9.0 Governing law
These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
Terms & Conditions for Subscription / Future Pay
Ordering Process & Product Availability
Once you have subscribed to regular deliveries for Products, products will be ordered and delivered automatically at the delivery frequency chosen by you at the time of subscription without any further action required by you. Some subscription and product details (including price, discount and availability) may change over time. Each order will be subject to the then applicable subscription and product details. Before each order is dispatched to you, you will receive an order confirmation message including order details and instructions for cancelling or modifying your order if you wish to do so (“Order Confirmation”). You will also be sent an e-mail at the address associated with your account or a message on the message centre in Your Account confirming to you that we have, dispatched the Product to you (“Dispatch Confirmation”).
Each order constitutes a separate offer from you to purchase a Product. The contract of sale for each Product is concluded when the product is dispatched to you and you receive a Dispatch Confirmation.
If any Product is not available on the date it is scheduled to be dispatched to you, you will be notified of the delay and we, will attempt to fulfil the order within two weeks of the original dispatch date. If the Product becomes available during that two-week period, it will be dispatched to you without any further action required by you. Delay due to non-availability of any Product will not affect the terms applicable to any other subscriptions you may have or to future orders for the same subscription.
If any Product is no longer available, your subscription may be changed to a suitable replacement. You will be notified of this change. If you do not wish to continue with your subscription for a replacement product, you may cancel your subscription.

Price, Payment & Renewal
For each subscription order you will be charged the price (including VAT where appropriate) of each Product on the day your subscription order is processed, as detailed in the Order Confirmation.
The discount you receive will be the discount applicable to your Products at the time your order is processed, as detailed in the Order Confirmation. Temporary discounts and time limited or special offers only apply to orders placed while that discount or offer is available.
Your subscription(s) continue until cancelled. The price of each order will be charged to the payment method used to create your subscription. If we are unable to complete your order using the payment method you used to create your subscription or otherwise indicated by you, you authorise us to update your subscription with another payment method we have on record for you and to charge that payment method for your orders. If we do not have another payment method on record for you, or are unable to charge any payment method we have on record for you for your Subscription orders, your subscription(s) will be cancelled.
Cancellation or Modification of a Subscription / Future Pay
You may modify, pause or cancel your subscription(s) at any time. Cancellation or modification will not affect orders for which you have already received Dispatch Confirmation. You can cancel, modify or pause your subscription(s) by sending an email to email@example.com at least 7 working days before order is to be dispatched.
We retain, the right to cancel your subscriptions at any time. If your subscription is cancelled, you will be notified, and you will only be charged for subscription orders for which you have already received a Dispatch Confirmation. Failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.
If a subscription(s) is cancelled, you will only be charged for the subscription orders dispatched to you and no further orders for that Product will be placed.
If you reactivate a subscription that you previously cancelled, any discount applicable to your reactivated subscription may not be the same discount that was in effect prior to cancellation. The new discount will be applied to your future orders of that subscription.
If any problems arise with your delivery address, NÜ account or payment method, which we are unable to address, we will notify you via e-mail using the e-mail address associated with your subscription or via the message centre of Your Account and your subscription(s) will be automatically placed on hold. No additional orders will be processed or dispatched until the problem is resolved.
Overview of terms for Subscription / Future Pay
Set up your account for recurring orders by choosing the product, size (where applicable) and quantity.
Choose the frequency of payment i.e. (weekly, fortnightly, monthly, quarterly, half yearly, annually or a customised date) at your preference.
This is a rolling contract and rolls over after every payment indefinitely, until you cancel it, modify it or pause it, by sending email to firstname.lastname@example.org we will reply acknowledging and confirming cancellation, as long as your goods haven’t already been dispatched (usually 7 working days before dispatch is required, but shorter notice can, in some situations, be accepted).
This does not infringe on your customer rights.
